El Juzgado Cuarto Civil Municipal Oral de Tunja negó las solicitudes de nulidad y aclaración presentadas por Euclides Rivera Murillo, presidente de la Junta Directiva de la Cámara de Comercio de Tunja, dentro del segundo incidente de desacato derivado de una acción de tutela promovida por John Jairo Martínez Álvarez.
La decisión fue adoptada mediante auto del 29 de mayo de 2026, luego de que el expediente fuera devuelto por el Juzgado Cuarto Civil del Circuito de Tunja para resolver las solicitudes que permanecían pendientes antes de continuar con el trámite de consulta de las sanciones impuestas.
Rivera Murillo había solicitado la nulidad de las actuaciones adelantadas desde el 25 de mayo, argumentando una presunta omisión del despacho judicial al no pronunciarse sobre una solicitud de prueba por informe presentada el 21 de mayo. De igual manera, pidió aclarar varios aspectos relacionados con la providencia sancionatoria emitida dentro del incidente de desacato.
Tras revisar los argumentos expuestos y el desarrollo procesal del caso, el juzgado concluyó que no existían motivos jurídicos suficientes para acceder a las pretensiones formuladas, razón por la cual rechazó ambas solicitudes y dejó en firme todas las actuaciones adelantadas hasta el momento.
La providencia también reitera que el eje central del proceso continúa siendo la verificación del cumplimiento de la sentencia de tutela proferida el 13 de abril de 2026, mediante la cual se ordenó el reintegro de John Jairo Martínez Álvarez a su cargo, así como el pago de los salarios, prestaciones sociales y demás emolumentos dejados de percibir durante el tiempo de desvinculación.
Con esta determinación, el expediente será remitido nuevamente al Juzgado Cuarto Civil del Circuito de Tunja, despacho encargado de continuar con el trámite de consulta de las sanciones impuestas a seis integrantes de la Junta Directiva de la Cámara de Comercio de Tunja.
El proceso judicial sigue abierto y las autoridades competentes continuarán verificando si la entidad acata plenamente las órdenes impartidas por el juez constitucional, en un caso que ha generado atención en distintos sectores por las implicaciones administrativas y legales que rodean el cumplimiento de las decisiones de tutela.
