Un grupo de universidades privadas en Colombia solicitó a la Corte Constitucional revisar y declarar inconstitucional el nuevo impuesto al patrimonio establecido por el Gobierno nacional mediante el Decreto 0173 de 2026, una medida adoptada en el marco de la emergencia económica decretada por los desastres climáticos en el país.
La petición fue presentada por la Asociación Colombiana de Universidades (ASCUN), organización que agrupa a decenas de instituciones de educación superior. Según el documento enviado al alto tribunal, el nuevo gravamen podría afectar la estabilidad financiera de las universidades privadas y comprometer recursos que actualmente se destinan a la educación y al desarrollo académico.
De acuerdo con cálculos del sector, cerca de 100 universidades privadas podrían verse impactadas por la medida. El impuesto obligaría a algunas instituciones a pagar montos que van desde 300 millones hasta 23.000 millones de pesos, lo que en conjunto representaría aproximadamente 135.000 millones de pesos para todo el sistema universitario privado.
Los representantes de las universidades argumentan que la norma presenta varios problemas jurídicos. Entre ellos, señalan que el decreto no justifica de forma clara la necesidad de aplicar el impuesto a entidades sin ánimo de lucro, que podría vulnerar el principio de igualdad y que también afectaría la autonomía universitaria al obligar a redirigir recursos educativos hacia el pago de tributos.
Desde ASCUN también advierten que la aplicación del impuesto podría generar efectos indirectos en los estudiantes, como una posible reducción en becas o incluso aumentos en las matrículas, debido a la presión financiera que tendrían que asumir las instituciones.
Mientras tanto, la Corte Constitucional deberá estudiar los argumentos presentados por el sector educativo y determinar si el decreto se ajusta a la Constitución. La decisión será clave para definir si las universidades privadas deberán asumir este nuevo tributo o si quedarán excluidas de la medida fiscal impulsada por el Gobierno.
